The mother claimed one of the four men recorded an explicit video of her daughter before sharing it. The complainant has stated that the sexual activity was consensual, but the recording of it was not. Asencio, who was named in Madrid's starting XI for their Champions League clash with Manchester City on Tuesday night, appealed to the Provincial Court of Las Palmas to be dropped as a suspect in the case on the grounds that the evidence was speculative, but the charges against him have been upheld.

The court determined that there are 'reasonable indications' of criminal activity, with Asencio facing allegations of committing the crime of discovery and disclosure of secrets, plus distributing child pornography. With the alleged victim being a minor, Asencio would be looking at a sentence of between two to three years in jail and a fine. The alleged incident occurred before Asencio had made his senior debut for Madrid.
