The charges alleged that Denning "failed to navigate the vessel with care, caution and reasonable consideration for the occupants of other vessels, thereby causing danger to another vessel".

The court heard that the submarine had to slow down and make an early turn to avoid a collision, as Denning eventually veered starboard when just 137m away from the sub, breaching the 250m exclusion zone.

Despite police launches escorting the sub and trying to redirect the fishing boat onto a safer path, complete with blue lights, sirens, and audible warnings, the Girl Rona ignored the attempts.
