In the 21-page legal document linked to the lawsuits sees lawyers for Walliams claim: "The Claimant (Walliams) now understands that, unknown to him at the time, his microphone was kept on and recording throughout the whole filming day, including breaks, during his whole tenure as a judge on the show.".

Walliams sat alongside the likes of Simon Cowell, Amanda Holden and Alesha Dixon on the BGT panel for over 10 years before his abrupt departure from the ITV show in 2022, with former Strictly Come Dancing star Bruno Tonioli replacing the comic the following year.

According to a report seen by The Sun last year, a psychiatrist who has been treating Walliams for many years reportedly said that the TV star's depression was "possibly the worst since I first met him" after leaked audio was made public.

At the time, a spokesperson for BGT's production company Thames said that the language used by Walliams was "inappropriate" and that "those involved have been spoken to and reminded of their responsibilities and the show's expectations as to future professional conduct.".

Walliams went on to sue BGT makers Fremantle in a High Court writ, claiming Fremantle committed a massive breach of data protection laws by "recording, transcribing and retaining" private chats for a whole decade.
